Lawful Purpose
Services provided by BITCOM may be used for any lawful purpose for which the service is technically suited consistent with the transmission and switching parameters of the telecommunications facilities utilized in the provision of the service. BITCOM’S services are provided subject to the condition that they will not be used for any unlawful and/or fraudulent purpose. Services will not be furnished if any law enforcement agency, acting within its jurisdiction, advises BITCOM that such services are being used or are likely to be used in violation of the law and/or in a fraudulent manner. If BITCOM receives other evidence giving reasonable cause to believe that such services are being used or are likely to be used for unlawful and/or fraudulent purposes, it may either discontinue or deny the services and/or refer the matter to the appropriate law enforcement agency in accordance with law and/or Commission rules.
Any individual who uses or receives BITCOM’Ss services other than under the provisions of an accepted application for service and a current Customer relationship shall be liable for the appropriate rates and charges for the service received and for BITCOM’S costs of investigation and collection.
Equipment and Facilities

Equipment and Facilities
The operating characteristics of Customer premises equipment or communications systems connected to BITCOM’Ss network must not interfere with, or impair, any of the services offered by BITCOM. Additionally, connected Customer premises equipment must not endanger the safety of BITCOM employees or the public, damage or interfere with the proper functioning of BITCOM’S equipment, or otherwise injure the public in its use of BITCOM’Ss services.The Customer shall be responsible for damages to BITCOM’Ss facilities used in the provision of regulated services caused by the negligence or willful act of the Customer or those using BITCOM’S service through the Customer. The Customer may not physically modify or intrude upon, rearrange, disconnect, remove, or attempt to repair any of BITCOM’S facilities except upon written consent of BITCOM.
The Customer's obligation to BITCOM is the same whether the facilities involved are BITCOM’S facilities or are facilities leased by BITCOM from another party. If BITCOM incurs expenses due to the Customer's actions that result in damage or impairment of BITCOM owned or leased facilities, BITCOM will pass on to the Customer any and all expenses to repair BITCOM’S facilities or that the owner imposes on BITCOM for leased facilities.
Cancellation
Cancellation
Customer may cancel service by providing written notice to BITCOM thirty (30) days prior to cancellation, provided they are not executed any term commitment and then such cancellation prevledges are outlined in the Custeomer’s Service Agreement (CSA).Customer is responsible for usage charges while still connected to the BITCOM’S service, even if the customer utilizes services rendered after the Customers request for cancellation has been made notice and the payment of charges, if any, for service has been made.
BITCOM may immediately discontinue furnishing the service to a Customer without incurring liability:
• If there is a condition determined in BITCOM’S sole discretion to be hazardous to the Customer, to other Customers of BITCOM, to BITCOM’S equipment, to the public or to employees or agents of BITCOM; or
• If BITCOM deems refusal or disconnection necessary to protect itself or third parties against fraud or to otherwise protect its personnel, agents, facilities or services; or
• For non-compliance with and/or violation of any State or municipal law, ordinance or regulation pertaining to the service; or
• For use of BITCOM’S Services for any purpose other than that described in the application; or
• In the event of Customer use of equipment in such a manner as to adversely affect BITCOM’S equipment or the Service to others; or
• In the event of tampering with the equipment furnished and owned by BITCOM; or
• In the event of unauthorized or fraudulent use of the service.
BITCOM may discontinue service according to the following conditions upon written notice, pursuant to applicable state and federal law.
• For the non-payment of any proper charge as provided by BITCOM’S Tariff; or
• For Customer's breach of the contract for service between BITCOM and Customer.
The discontinuance of Service(s) by BITCOM pursuant to this section does not relieve the Customer of any obligations to pay Company for charges due and owing for Service(s) furnished up to the time of discontinuance. The remedies set forth herein are not exclusive, and BITCOM is at all times to be entitled to all the rights available to it under law or equity.

Taxes
The Customer is responsible for payment of all federal, state and local taxes, franchise, excise and other fees applicable to the Services, including, but not limited to: sales, use, excise, franchise, access, universal service, 911 services and handicapped services.
